Anthem Charity Classic Give, Golf, Dine

 

Anthem Charity Classic

The Anthem Charity Classic kicks off on March 11th at the Anthem Country Club as part of the 2018 Charity Classic Month. For the entire month of March the Anthem Country Club and Golf course will be open to the public!

The purpose of the event is to raise money for the charities Augie’s Quest, Clubcorp Employee Partner’s Care Foundation, and the Foothills Foodbank.

The Events

This month long event includes a Golf Tournament, Bocce Ball Tournament, Pickle-ball Tournament, Men’s Doubles Tennis Tournament, Mixed Double’s Tennis Tournament, a Dinner Dance and Silent Action, and a ST. Patrick’s Day walk.

  • ClubCorp Employee Partners Care Foundation (E.P.C.F.), a 501(c)3 fund established to help to help Employee Partners of ClubCorp’s family of Clubs in need of financial assistance in times of crisis.
  • The Foothills Food Bank, a 501(c)3 food bank and resource center that provides food for those in need, financial assistance to individuals and families in the foothills area and referral information for any number of programs and helpful organizations.

HOA Who, What, Where, Why?

If you live in Phoenix you probably know that HOA stands for Home Owner’s Association, but what is a Home Owner’s Association? What does it mean to live in a community with an HOA? And why might you want to live in one?

First thing’s first, a clear cut definition: the HOA has power and authority to impose the rules set forth by the Declaration of Covenants, Conditions, and Restrictions (CC&Rs), and the CC&Rs define the scope at which the HOA can act within the regulation of the Federal law and the individual State Laws.

In short the Home Owner’s Associations act as an a governing body that oversees the enforcement of the CC&Rs.


The Who: Board of Directors

The board of directors are members of the community that are either appointed or elected by the others in the community. You can think of them as being similar to the Board of Directors for a company, or like a mini-government underneath acting below the local government. They are typically made up of a President, Vice-President, Treasurer, Secretary, and the Board Members.

The President and Vice President both serve leadership roles and have an in depth knowledge of the CC&Rs. They are in charge of running the HOA meetings, appointing committees to address issues brought forth by the community, and deciding when other members of the HOA are allowed to speak to the meeting.

The Treasurer oversees the financials, securities, and funds available to the associations. Typically they will be in charge of billing, collections, how to spend the money, and are tasked with the job of creating the annual budget for the community. At meetings they will give an updated report of where the community’s finances are and their projections for the rest of the year.

The Secretary is the person that members look to when they need to fact check what happened at the last meeting. They are in charge of taking the notes for the meetings, securely storing the notes, and having the notes available to members should they need them.


The What: Home Owners Association

A HOA is an organization that enforces the CC&Rs, collects dues, and creates a budget for the community. The structure of the organization is laid out in the articles of incorporation and the bylaws created by the organization. The Home Owner’s Association is usually comprised of the members of the community, but in some planned development communities the builder will have control over the association until a certain number of lots are sold.

Association Dues

If you are thinking about buying a home located in a HOA you will have to take into consideration that you will be paying HOA dues along with your regular mortgage payment. The HOA membership dues are used by the association for maintenance and improvements to the common areas. Common areas are typically anything that is not part of a HOA home owner’s house, but still a part of the community. This can include: recreation centers, pool areas, parks, parking management like parking lot striping, and walkways within the community.

Covenants, Conditions, and Restrictions

These are the rules that govern the community and put limitations on what the home owners in the community can do with their property. Just like in grade school when the teacher had written on the board that there was “No chewing gum allowed in her classroom” the Covenants, Conditions, and Restrictions (CC&Rs) can do the same for home owners. But instead of no gum chewing it can be “No business vehicles can be parked on the street” or “Your rocks can only be this color of brown” or “No wooden fences”. However, if you violate these rules you won’t be sent to detention and instead you might find yourself facing fines or a lawsuit depending the severity.

Checks and Balances

Although there is no regulatory body that oversees HOAs there are multiple federal and state statues that affect them. I’ll break down how these two levels of government see the HOA.

The federal laws concerning HOAs are focused on their organization and their financials. That means they need to be organized for the purpose of managing the property and that the money collected is going towards that goal.

There are many state laws affecting HOAs in arizona. The main one that regulates them is the Planned Communities statues of 1994 which address the formation and operation of master planned community HOAs. “these statutes address assessment increases, penalties, open meetings, disclosure of association records, resale disclosure, penalty and assessment liens, foreclosures, flag and political sign display, vehicle parking, solar energy restrictions, rental property requirements, architectural and design review committees and certain affairs of the boards of directors.” (Arizona State Senate Issue Brief)


The Why: Property Values

The main reason to own a home located in a HOA is protecting your property’s value. All of the rules, restrictions, and enforcement can sound overbearing for a community that want you live in, but as a home owner these rules can help maintain your home’s value. They can ensure that the neighborhood that you fell in love with will stay the same or improve!

That is where the association dues come into play as they are used to improve the community. This can be either through the maintenance of the common areas or improvements to the common areas. A good example of the common area maintenance is landscaping of parks and walkways. Say your community wanted to add a new jungle gym for the kids at the community park with the HOA you can make it happen. New water slide at the community pool? HOA can make that happen. Cut down that overgrown tree that’s hanging on your favorite walking path? HOA can make them go away by hiring a tree removal expert.

But what if that tree was hanging into your yard from your neighbors yard? Or what if your neighbors were storing their 40 foot motor home on the street in front of your home and you were worried you’d never see your front door again? The HOA can enforce the rules set forth in the CC&Rs so that you won’t have that tree hanging in your yard and you’ll see your front door again. Being in an HOA can give you the peace of mind that even if you get new neighbors the homes around you will still abide by the same rules. And this security can also be a benefit when trying to sell your home further down the line.


In Conclusion

HOAs are organizations created and developed from the CC&Rs that were made when the planned community was founded. This association is run by a board of directors comprised of members of the community. When you purchase a home in an HOA you are subject to the CC&Rs that apply to the property. Being in a HOA means that you have to pay HOA dues to the association. A HOA provides a number of benefits to the home owner such as common area maintenance, community improvements, and making sure the CC&Rs are followed.

What Impact Will The New Tax Code Have on Home Values?

Every month, CoreLogic releases its Home Price Insights Report. In that report, they forecast where they believe residential real estate prices will be in twelve months.

Below is a map, broken down by state, reflecting how home values are forecasted to change by the end of 2018 using data from the most recent report.

As we can see, CoreLogic projects an increase in home values in 49 of 50 states, and Washington, DC (there was insufficient data for HI). Nationwide, they see home prices increasing by 4.2%.

How might the new tax code impact these numbers?

Recently, the National Association of Realtors (NAR) conducted their own analysis to determine the impact the new tax code may have on home values. NAR’s analysis:

“…estimated how home prices will change in the upcoming year for each state, considering the impact of the new tax law and the momentum of jobs and housing inventory.”

Here is a map based on NAR’s analysis:

According to NAR, the new tax code will have an impact on home values across the country. However, the effect will be much less significant than what some originally thought.

Definitely an aggressive headline. However, as the final data on the 2017 housing market rolls in, we can definitely say one thing: If you are considering selling, IT IS TIME TO LIST YOUR HOME!

How did we finish 2017?

  1. New-home sales were at their highest level in a decade.
  2. Sales of previously owned homes were at their highest level in more than a decade.
  3. Starts of single-family homes were their strongest in a decade and applications to build such properties advanced to the fastest pace since August 2007.

And Bloomberg Business just reported:

“America’s housing market is gearing up for a robust year ahead. Builders are more optimistic, demand is strong and lean inventory is keeping prices elevated.”

And the National Association of Realtors revealed that buyer traffic is stronger this winter than it was during the spring buying season last year.

The only challenge to the market is a severe lack of inventory. A balanced market would have a full six-month supply of homes for sale. Currently, there is less than a four-month supply of inventory. This represents a decrease in supply of 9.7% from the same time last year.

With demand increasing and supply dropping, this may be the perfect time to get the best price for your home. Let’s get together to see whether that is the case in your neighborhood.

The Anthem Community Council charges a flat $365.00 fee for the preparation of Resale Disclosure documents, including a standardized PUD Questionnaire and other related documents.   Updates to the Resale Document are $25.00 each.  Rush charges are $25.00.   These fees are collected by the TITLE Company at close of escrow.  This fee covers both the Master and Sub-Association.

 

PUD Questionnaire (ONLY)                                             Calculation:         $75.00 flat fee

The Anthem Community charges a flat $75.00 fee for the preparation of a PUD Questionnaire (only) as requested by any interested party.  This fee is NOT charged if a full Resale Disclosure Package is ordered.  This fee covers both the Master and Sub-Association.

 

Setup Fee  (Village at Anthem ONLY)                          Calculation:         $30.00 flat fee

For property transitions in the Village at Anthem (ONLY), there is a $30.00 setup fee payable by the buyer for establishing the account on the books of their managing agent.

 

Refinance Statements                                                      Calculation:         $75.00 flat fee

The Anthem Community charges a flat $75.00 fee for the preparation of a Refinance Statement. This are invoiced directly to the current owner’s account with the Anthem Community Council.


RESALE DISCLOSURE PACKAGE –VALID THRU DEC. 31, 2018

 

Community Enhancement Fee (Non-Residential)     Calculation:         Sliding Scale based on selling price of property

This fee is payable to the Anthem Community Council upon close of escrow, collected by the TITLE Company.

 

Resale Disclosure Fees                                                   Calculation:         $365.00 flat fee

Resale Disclosure Package – Contents

In preparing the Resale Disclosure Package on behalf of the Buyer, Seller and Title Company, the Anthem Council provides email and electronic information to the various parties which includes, but is not limited to:

  • Bylaws and Governing Documents of the Sub-Association and Master Entity
  • Covenants, Conditions and Restrictions of the Sub-Association and Master Entity
  • A Schedule of Fees and Amounts Due and Collectible on the Property at time of Close of Escrow
  • A Detailed Planned Unit Development Questionnaire (PUD) Which Responds to Issues and Questions of a Transition of Ownership of a Property. The Anthem Council does NOT provide a customized response document to any Title Company or Financing Organization – We provide only our Standard PUD Questionnaire.
  • Information Referencing the Insurances Carried by the Sub-Association and Master Entity
  • A Schedule of Any Current or In-Process Legal Proceedings Against the Sub-Association or Master Entity
  • Information Containing all Other Legally-Required Information Required to be Provided by Law by the Master Entity or Sub-Association as to the Property; Financial Condition of the Community;  Ongoing Assessments;  Special Assessments;  Funding Held by the Sub-Association or Master Entity for Reserve Fund;  Contact Information
  • Current Year Operating Fund Budget for the Sub-Association and Master Entity
  • Immediately Past Year Audited Financial Statement for the Sub-Association and Master Entity
  • Most Recent Reserve Study(ies) for the Sub-Association and Master Entity
  • A link to the Anthem Community Website, OnlineAtAnthem.com, which provides all of the above information

EXPLANATORY NOTES ON FINANCIAL OBLIGATIONS – 2018

 

  • Residential Assessments are due quarterly in advance within the Anthem Community, for the Anthem Community Council (ACC) and its sub-associations: APCA (Parkside);  ACCCA (CountryClub);  and VILL (Villages at Anthem Condominiums)

 

  • Quarterly Assessments are due on January 01, April 01, July 01 and October 01 of each calendar year, paying in advance

 

  • Assessments are considered LATE if received after the 1st of the month due. Anthem currently provides a grace period through the 15th of the month due or the Friday preceding the 15th if the 15th falls on a weekend.   Late fees of $15.00 are assessed to all late payments not received by the ACC at the close of the grace period.  Additional collection costs accrue if the assessment obligations remain outstanding beyond the grace period.

 

  • The ability to pay assessments on a monthly basis is ONLY provided if the property owner signs up for the ACC’s “Direct Deposit ACH Program”. There is no authorized “create your own” monthly payment program – only the ACH program.

 

  • Assessments or any other charges outstanding beyond 30 days after due date are subject to a $30.00 collections letter fee. Assessments or any other charges outstanding beyond 60 days after due date are subject to a $45.00 collections letter fee.Assessments or any other charges outstanding beyond 75 days after due date are subject to a $50.00 collections letter fee.

Subsequent Collection Letters, if issued are subject to a $50.00 collections fee for each letter issued.

 

  • Assessments or any other charges unpaid after 90 days may be handled by a collections attorney and all incurred legal charges are added to the property’s owners account as incurred.

 

  • Payments by check, ECheck or through ACH which are rejected by the bank for insufficient funds incur a $25 “NSF” fee.

 

  • Payments should be made to the lockbox at: Anthem Community Council     PO BOX 65464   Phoenix, AZ  85082-5464

All payments should be accompanied by the payment coupon which is either mailed or emailed to owners of record.

 


HOW REALTORS AND TITLE COMPANIES CAN OBTAIN RESALE PACKAGES  – 2018

 

  • Parties interested in ordering either Refinancing Packages, PUD Questionnaires, or Resale Disclosure Packages should first visit the Anthem Website at OnlineAtAnthem.com

 

  • On the main page of the community website, select the button labeled: “Disclosure and Title Requests”

 

  • Read the instructions on the next web page that appears and fill in the electronic form to order the information desired.

 

  • Please note that the Anthem Community Council does not take orders for Resale or Refinancing packages by telephone or by email. Please use our website for all new orders for packages as well as for updates to existing packages.

 

 

SPECIFICALLY FOR RESALES WITHIN THE ANTHEM COUNTRY CLUB HOA – 2018

 

  • Under Anthem’s governing documents, property owners within the ACCCA (Anthem Country Club Community Association) are obligated to also be Social Members of the Anthem Golf and Country Club (AGCC), a third-party, privately owned company that owns and manages the Golf Courses and Amenities which are physically located within the property of the ACCCA HOA. When a property transitions, Title Companies and Realtors should also contact the AGCC for a Resale Document which will identify any charges owed by the Seller, as well as Transfer Fees and Prepaid Dues which are a buyer’s obligation.

 

 

ANTHEM “ACH” DIRECT DEBIT PROGRAM FOR PAYING ASSESSMENTS MONTHLY

 

  • The Anthem Community Council offers to property owners the ability to pay their assessments on a monthly basis through its “ACH” Direct Debit Program. This is the ONLY authorized means of paying assessments monthly.

 

  • To obtain an application for ACH Direct Debit, please do the following: (a)  Visit the community website at OnlineAtAnthem.com ; (b) Click on the button on the home page titled “Pay & View Assessments” ;  (c) download and print out the ACH Application form;  (d) fill out and sign the ACH Application form and send it, and a voided check, to us at AR@AnthemCouncil.com

 

  • Owners remain in the ACH until either (a) they elect to discontinue their participation by sending a termination email to AR@AnthemCouncil.com  or (b) when an ACH is withdrawn from the owner’s account, the withdrawal fails as a result of insufficient funds in the account.     In participation in the ACH program is terminated by either (a) or (b), an owner, once they have brought their account balance current, can then reapply to Anthem to re-join the ACH program.

 

ANTHEM “OPT-IN” FOR RECEIVING QUARTERLY STATEMENTS VIA EMAIL

 

  • The Anthem Community Council offers to property owners the option to receive their quarterly assessment and balances due statements by either regular US Mail or by email. The ACC strongly encourages receiving documents via email as it removes any potential delivery issues, for which the ACC is NOT RESPONSIBLE for.  To participate in the email program, please send an email to Accounting@AnthemCouncil.com and indicate you wish to “OPT-IN” for email delivery.   Provide your name, your property address, your telephone number and up to 3 email addresses where the documents can be emailed to.

 

  • Quarterly Assessments are due on January 01, April 01, July 01 and October 01 of each calendar year, paying in advance

 

  • Emailed statements are usually delivered to property owners approximately 45 days prior to due date. Statements mailed via US Postal Service are usually delivered to property owners approximately 30 days prior to the due date.

3rd Quarter MLS Sales Up Only 2% Over 2016

High End MLS Sales Over $600K Up 27%

For Buyers: The median home size sold through the MLS this year is 1,774 square feet. Interestingly, this measure has not fluctuated more than a couple square feet up or down since 2015. Considering the increasing cost per square foot, the fact that the median sized home sold has not fluctuated much means that buyers are willing to pay more for the right sized home if they have the choice. For buyers with less flexibility on price, the cost of waiting comes in the form of sacrificing extra closet space, work space, or even a bedroom. Last year, the median home size for buyers in the $150K-$175K price range was 1,470sf. This year it’s only 1,380sf, a difference of 90 square feet.

For Sellers: The first half of 2017 was more exciting than the second half is turning out to be so far for MLS sales. 1st Quarter 2017 MLS sales outperformed 2016 by 14% and 2nd Quarter sales were up 7%, so a 2% growth rate for the 3rd Quarter puts a damper on our excitement. Low supply in the lower price ranges is mostly to blame as it’s difficult to have record sales growth if there are fewer people willing to sell their home. There are more people willing to put their home on the market in the higher price ranges however. New listings over $600K were up nearly 10% in the 3rd Quarter and sales were up an impressive 27%.

2016 Sales up 7% over 2015

2016 Median Sales Price 7.7% Higher than 2015

Welcome to 2017!

The headlines these days are full of projections and reflections for the Phoenix Metropolitan Area resident real estate market.  All together the Anthem, Desert Hills, Scottsdale and Phoenix real estate markets had a great year!

To complement our monthly measures here are some year-end numbers to reflect on.

2016 MLS Sales – Up 7.0% overall compared to 2015

  • 72.9% of sales were under $300,000 (# of sales up 3.4%)

  • 19.6% of sales were between $300,000 and $500,000 (# of sales up 20.2%)

  •  6.1% of sales were between $500,000 and $1,000,000 (# of sales up 15.4%)

  • 1.4% of sales were over $1,000,000 (# of sales up 8.1%)

2016 New Listings – up 4.6% overall compared to 2015

  • 65.8% of new listings were under $300,000 (# of new listings up 0.8%)

  • 22.0% of new listings were between $300,000 and $500,000 (# of new listings up 13.5%)

  • 9.2% of new listings were between $500,000 and $1,000,000 (# of new listings up 13.6%)

  • 3.0% of new listings were over $1,000,000 (# of new listings up 5.7%)

2016 Appreciation based on Annual Sales Price per Square Foot – up 5.4% from 2015

  • Under $300,000 – up 7.6%

  • $300,000 – $500,000 – up 2.0%

  • $500,000 – $1,000,000 – Less than 1% change

  • Over $1,000,000 – Less than 1% change

It’s been a good news/bad news year for sellers over $500,000.  The good news is that more buyers purchased in the higher price ranges in 2016 than in 2015.  The bad news is the neighbors also noticed increased demand and listed their homes too, increasing the number of new listings on the market simultaneously.  This increased supply, combined with builders getting in on the action over $250,000, created a more competitive and balanced market and put price increases in check.

It’s been good news/bad news for buyers under $300,000.  The good news is their homes have appreciated nicely over the past year.  The bad news, finding move-in ready homes and winning the bid was more stressful and competitive than many expected.  Especially for single family homes under $200,000.  (Yes, they do exist.)

Looking forward in the short term, the market can expect more buyers emerging with improved credit scores as we move farther away in time from the foreclosure and short sale crisis.  Recent announcements regarding FHA loan limit increases and lower mortgage insurance premium fees signify a loosening up in lending that will contribute to more demand for listings under $300,000. Higher interest rates will cause some buyers to purchase smaller homes than they anticipated, putting even more pressure on the market under $300,000; which is already short of supply for existing demand.  With nearly 73% of all sales in this price point, it’s reasonable to expect appreciation to continue to be positive for the Phoenix Metropolitan, Anthem, Desert Hills, Scottsdale and Phoenix real estate marketsoverall.
